Terms of Service

1. Agreement and eligibility

These Terms of Service govern your use of the Munchio mobile application, munchio.app, and related support services (together, “Munchio”). Munchio is operated by Engineers Space LLC. By creating an account or using Munchio, you agree to these terms and the Privacy Policy.

You must be at least 18 years old and legally able to enter into this agreement. If you do not agree, do not use Munchio.

2. Account and access

Munchio uses passwordless sign-in through email one-time codes, Apple, or Google. You are responsible for controlling access to your email, Apple, and Google accounts and for activity performed through your Munchio account.

Provide accurate account information and notify [email protected] promptly if you believe your account has been accessed without permission. Do not share one-time codes, access tokens, or authentication links with anyone, including support.

3. Service and AI estimates

Munchio helps you record food by photo, voice, typed description, catalog search, or manual entry and review editable nutrition estimates. AI-generated names, portions, calories, macronutrients, summaries, and meal suggestions are probabilistic estimates. They may be incomplete or wrong, and you are responsible for reviewing and correcting them before relying on or saving them.

Munchio does not guarantee calorie or nutrient accuracy from a photo, recording, description, catalog result, or generated suggestion. Never use Munchio to make an emergency or time-critical medical decision.

4. Your content

You retain your rights in the food descriptions, diary entries, corrections, preferences, photos, recordings, and other information you submit. You give Engineers Space LLC a limited, non-exclusive license to process that content only as needed to provide, secure, troubleshoot, and improve the operation of Munchio and to comply with law.

Raw food photos and voice recordings are processed transiently and are not saved in Munchio storage. A contracted AI processor receives the input needed to perform the requested capture. More detail appears in the Privacy Policy and Consumer Health Data Privacy Notice.

Submit only content you have the right to use. Do not include another person’s confidential information or medical records in a capture or support request.

5. Subscriptions and purchases

Munchio may offer weekly, monthly, and annual auto-renewing subscriptions through Apple’s App Store or Google Play. The exact localized price, billing period, taxes, trial terms if any, and renewal details are shown by the store before purchase.

• Your subscription renews automatically unless you cancel through the store before the renewal date shown by that store.
• Apple or Google processes payment and controls store billing, cancellation, and refunds, subject to applicable law and store rules.
• Deleting your Munchio account does not automatically cancel a store subscription. Cancel it separately in your App Store or Google Play subscription settings.
• Losing paid access never blocks manual logging, existing history, or previously generated summaries.

6. Acceptable use

You must not use Munchio to:

• break the law or infringe another person’s rights;
• submit malicious code, probe security, bypass rate limits, quotas, entitlements, or account boundaries;
• abuse, disrupt, overload, reverse engineer, scrape, or interfere with Munchio or its providers except where law expressly permits;
• impersonate another person, create accounts fraudulently, or obtain access to another user’s data; or
• present Munchio output as a diagnosis, treatment instruction, guaranteed measurement, or professional medical advice.

7. Ownership

Engineers Space LLC and its licensors retain all rights in Munchio’s software, design, documentation, trademarks, and service content other than your content. These terms give you a personal, limited, revocable, non-transferable license to use Munchio for its intended purpose.

If you send feedback, you allow Engineers Space LLC to use it without restriction or compensation, but feedback does not transfer ownership of your diary or personal data.

8. Privacy

The Privacy Policy explains what Munchio collects, why it is used, which service providers process it, retention, and your choices. The Consumer Health Data Privacy Notice provides additional disclosures and rights for nutrition and related wellness data.

9. Third-party services

Munchio depends on third-party identity, hosting, database, email, AI, purchase, and app-store services. Their services may be unavailable, delayed, changed, or governed by their own terms. Engineers Space LLC does not control Apple, Google, OpenAI, RevenueCat, Supabase, Resend, or Cloudflare policies and is not responsible for their independent acts except where applicable law provides otherwise.

10. Suspension and termination

You may stop using Munchio at any time and may delete your account from the app or start a request through the Account Deletion page.

Engineers Space LLC may suspend or terminate access when reasonably necessary to address unlawful use, a material breach of these terms, fraud, a security risk, provider or store requirements, or discontinued service. Where practical, we will provide notice and an opportunity to export data before a non-urgent termination.

11. Availability and disclaimers

To the maximum extent permitted by law, Munchio is provided “as is” and “as available.” Engineers Space LLC disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not promise that estimates, reflections, catalog data, or suggestions will be accurate, complete, or suitable for your circumstances.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law, and mandatory consumer rights remain unaffected.

12. Limitation of liability

To the maximum extent permitted by law, Engineers Space LLC and its officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for decisions made from an AI estimate or suggestion.

To the maximum extent permitted by law, aggregate liability arising from Munchio will not exceed the greater of the amount you paid for Munchio during the 12 months before the event giving rise to the claim or US$100. Nothing in these terms limits liability that cannot lawfully be limited, including applicable statutory consumer rights.

13. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Courts located in Sheridan County, Wyoming have jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere.

Before filing a claim, please contact [email protected] so we can try to resolve the issue informally. This paragraph does not prevent either party from seeking urgent injunctive relief or using a lawful small-claims process.

14. Changes and contact

We may update these terms when Munchio, its providers, or applicable law changes. We will update the date above and provide additional notice when required. Continued use after an update becomes effective means you accept the revised terms where permitted by law.
