Terms of Service

1. Agreement and eligibility

These Terms of Service govern your use of the Munchio mobile application, munchio.app, and related support services (together, “Munchio”). Munchio is operated by Engineers Space LLC. By creating an account or using Munchio, you agree to these terms and the Privacy Policy.

You must be at least 18 years old and legally able to enter into this agreement. If you do not agree, do not use Munchio.

If you download Munchio from Apple’s App Store or Google Play, the store’s own terms also apply to that download and to purchases made through the store. Section 11 contains additional terms required by the stores.

2. Account and access

Munchio uses passwordless sign-in through email one-time codes, Apple, or Google. You are responsible for controlling access to your email, Apple, and Google accounts and for activity performed through your Munchio account.

Provide accurate account information and notify [email protected] promptly if you believe your account has been accessed without permission. Do not share one-time codes, access tokens, or authentication links with anyone, including support.

Your account is personal. Do not use Munchio to keep a diary for another person, including a child, without that person’s knowledge and consent, and never for a person under 18.

3. Service and AI estimates

Munchio helps you record food by photo, voice, typed description, catalog search, or manual entry and review editable nutrition estimates. AI-generated names, portions, calories, macronutrients, summaries, and meal suggestions are probabilistic estimates. They may be incomplete or wrong, and you are responsible for reviewing and correcting them before relying on or saving them.

Munchio does not guarantee calorie or nutrient accuracy from a photo, recording, description, catalog result, or generated suggestion. Never use Munchio to make an emergency or time-critical medical decision.

If you have or are recovering from an eating disorder, are pregnant or breastfeeding, live with diabetes, kidney disease, a food allergy, or another condition affected by what you eat, or take medication that interacts with food, talk with a qualified professional before relying on any calorie or nutrition tool, including Munchio. The optional daily energy reference is a rounded general estimate, not a target, prescription, or medical recommendation.

Munchio evolves. We may add, change, limit, or remove features, models, catalogs, and quotas over time. Where a change materially reduces functionality you have paid for, section 6 and the store’s rules govern your remedies.

4. Allergens and dietary exclusions

You may declare allergens and foods you want Munchio to avoid. Munchio applies those declarations as exclusions when it generates meal suggestions from meals you have already saved. This feature is a convenience, not a safety control.

• Exclusions rely only on your declarations, the descriptions of meals you saved, and Munchio’s food classification. Munchio cannot see ingredients, labels, recipe changes, substitutions, preparation methods, or cross-contact.
• Munchio does not infer an allergy or intolerance from your diary and does not warn you about foods you have not declared.
• An AI capture may fail to recognize an ingredient or allergen that is present in a photo, recording, or description, or may misidentify a food.
• Do not rely on Munchio to manage a severe or life-threatening allergy, celiac disease, or a medically required dietary restriction. Follow the guidance of your clinician and the product label.

5. Your content and AI outputs

You retain your rights in the food descriptions, diary entries, corrections, preferences, photos, recordings, and other information you submit. You give Engineers Space LLC a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display that content only as needed to provide, secure, troubleshoot, and improve the operation of Munchio and to comply with law.

Munchio does not use your diary, photos, recordings, descriptions, or corrections to train or fine-tune AI models. Our AI provider processes capture requests under API terms that exclude training use unless the customer opts in, and Munchio has not opted in.

Raw food photos and voice recordings are processed transiently and are not saved in Munchio storage. A contracted AI processor receives the input needed to perform the requested capture. More detail appears in the Privacy Policy and Consumer Health Data Privacy Notice.

Subject to these terms, you may use the estimates, summaries, and suggestions Munchio generates for you for your own personal, non-commercial purposes. Outputs come from probabilistic models and may be similar or identical to outputs generated for other users. We do not promise that outputs are unique, and Engineers Space LLC and its licensors retain their rights in the underlying models, prompts, schemas, taxonomies, and catalog data.

Submit only content you have the right to use. Do not include another person’s face, confidential information, or medical records in a capture or support request. Keep people, documents, and unrelated personal items out of food photos and recordings.

6. Subscriptions and purchases

Munchio may offer weekly, monthly, and annual auto-renewing subscriptions through Apple’s App Store or Google Play. The exact localized price, billing period, taxes, trial or introductory terms if any, and renewal details are shown by the store before purchase.

• Your subscription renews automatically unless you cancel through the store before the renewal date shown by that store.
• Apple or Google processes payment and controls store billing, cancellation, and refunds, subject to applicable law and store rules. Refund requests go to the store where you purchased.
• Deleting your Munchio account does not automatically cancel a store subscription. Cancel it separately in your App Store or Google Play subscription settings.
• Losing paid access never blocks manual logging, existing history, or previously generated summaries.
• Free and paid usage limits, such as the number of AI captures included without a subscription or per day with one, are described in the app and may change. A change to a limit does not remove your saved diary.
• Prices may change. The store will notify you of a subscription price change and, where the store or law requires, ask for your agreement before the new price applies to a renewal.
• Purchases are also governed by the Apple Media Services Terms and Conditions or the Google Play Terms of Service, as applicable.

7. Acceptable use

You must not use Munchio to:

• break the law or infringe another person’s rights;
• submit malicious code, probe security, bypass rate limits, quotas, entitlements, store billing, or account boundaries;
• abuse, disrupt, overload, reverse engineer, scrape, or interfere with Munchio or its providers, or access Munchio through automated tools, bots, or agents, except where law expressly permits;
• impersonate another person, create accounts fraudulently, or obtain access to another user’s data;
• resell, sublicense, or provide Munchio or its outputs as a service to others, or use Munchio to build a competing product or dataset; or
• present Munchio output as a diagnosis, treatment instruction, guaranteed measurement, allergy-safety assurance, or professional medical advice.

8. Ownership

Engineers Space LLC and its licensors retain all rights in Munchio’s software, design, documentation, trademarks, and service content other than your content. These terms give you a personal, limited, revocable, non-transferable, non-sublicensable license to use Munchio for its intended purpose on devices you own or control.

If you send feedback, you allow Engineers Space LLC to use it without restriction or compensation, but feedback does not transfer ownership of your diary or personal data.

9. Privacy

The Privacy Policy explains what Munchio collects, why it is used, which service providers process it, retention, and your choices. The Consumer Health Data Privacy Notice provides additional disclosures and rights for nutrition and related wellness data.

10. Third-party services

Munchio depends on third-party identity, hosting, database, email, AI, purchase, and app-store services. Their services may be unavailable, delayed, changed, or governed by their own terms. Engineers Space LLC does not control Apple, Google, OpenAI, RevenueCat, Supabase, Resend, or Cloudflare policies and is not responsible for their independent acts except where applicable law provides otherwise.

11. App store terms

Apple App Store

If you obtained Munchio from Apple’s App Store, the following also applies, and Apple requires it to be included here.

• These terms are between you and Engineers Space LLC only, not Apple. Apple is not responsible for Munchio or its content.
• Your license is limited to a non-transferable license to use Munchio on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Munchio may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
• Engineers Space LLC, not Apple, is solely responsible for providing any maintenance and support for Munchio. Apple has no obligation to furnish any maintenance or support services.
• To the extent any warranty applies and Munchio fails to conform to it, you may notify Apple, and Apple will refund the purchase price you paid for Munchio, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the responsibility of Engineers Space LLC.
• Engineers Space LLC, not Apple, is responsible for addressing any claims by you or a third party relating to Munchio or your possession or use of it, including product liability claims, claims that Munchio fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar law.
• If a third party claims that Munchio or your possession and use of it infringes that party’s intellectual property rights, Engineers Space LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.
• You must comply with applicable third-party terms when using Munchio, such as your wireless carrier’s agreement.

Google Play

If you obtained Munchio from Google Play, the Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for Munchio, its content, or support.

12. Suspension and termination

You may stop using Munchio at any time and may delete your account from the app or start a request through the Account Deletion page.

Engineers Space LLC may suspend or terminate access when reasonably necessary to address unlawful use, a material breach of these terms, fraud, a security risk, provider or store requirements, or discontinued service. Where practical, we will provide notice and an opportunity to export data before a non-urgent termination.

We may discontinue Munchio or a paid feature. If we do, we will give reasonable advance notice where practical, keep export available during that period, and follow the store’s rules for any prepaid subscription period that is not delivered.

13. Availability and disclaimers

To the maximum extent permitted by law, Munchio is provided “as is” and “as available.” Engineers Space LLC disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not promise that estimates, reflections, catalog data, exclusions, or suggestions will be accurate, complete, or suitable for your circumstances.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law, and mandatory consumer rights remain unaffected.

14. Limitation of liability

To the maximum extent permitted by law, Engineers Space LLC and its officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for decisions made from an AI estimate, exclusion, or suggestion.

To the maximum extent permitted by law, aggregate liability arising from Munchio will not exceed the greater of the amount you paid for Munchio during the 12 months before the event giving rise to the claim or US$100. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, fraud, gross negligence, or willful misconduct, and applicable statutory consumer rights.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Engineers Space LLC and its officers, employees, and contractors from and against claims, damages, losses, and reasonable expenses, including reasonable legal fees, that arise from your content, your breach of these terms, your violation of law or of another person’s rights, or your misuse of Munchio.

This obligation does not apply to the extent a claim results from our own breach of these terms or our negligence, and it does not apply where consumer protection law prohibits it. We will notify you of a claim covered by this section and may participate in its defense with counsel of our choosing.

16. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Courts located in Sheridan County, Wyoming have jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim, or to rely on the law, of the place where you live.

Before filing a claim, please contact [email protected] with a description of the issue so we can try to resolve it informally within 30 days. This paragraph does not prevent either party from seeking urgent injunctive relief or using a lawful small-claims process.

If you live in the European Union, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. Engineers Space LLC is not obliged and does not commit to participate in alternative dispute resolution proceedings before a consumer arbitration body.

17. General terms

• Entire agreement. These terms, the Privacy Policy, the Consumer Health Data Privacy Notice, and any store terms that apply form the entire agreement between you and Engineers Space LLC about Munchio and replace prior agreements on that subject.
• Severability. If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in effect.
• No waiver. A failure or delay in enforcing a provision is not a waiver of it.
• Assignment. You may not assign or transfer these terms or your account. Engineers Space LLC may assign these terms to an affiliate or to a successor in a merger, acquisition, financing, or sale of assets, subject to the privacy obligations described in the Privacy Policy.
• Survival. Sections about your content and AI outputs, ownership, disclaimers, liability, indemnification, governing law, and these general terms survive termination.
• Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including provider or store outages, network failures, natural disasters, and government action. This does not excuse payment obligations already due.
• Notices. We may send notices to the email address on your account or through the app. Notices to us go to [email protected] or the postal address in section 18.
• Export and sanctions. You must comply with applicable export control and sanctions laws and may not use Munchio if you are a prohibited party or are located where United States law forbids providing the service.
• Language. These terms are written in English. A translation is provided for convenience only, and the English version controls where the law allows.
• Independent parties. These terms do not create a partnership, agency, employment, or joint venture, and no third party other than Apple under section 11 may enforce them.

18. Changes and contact

We may update these terms when Munchio, its providers, or applicable law changes. We will update the date above. For a material change, we will give at least 30 days’ notice by email or in the app before it takes effect where practical, unless the change is required sooner by law, by a store or provider, or to address a security risk. If you do not agree with a change, stop using Munchio and delete your account before the change takes effect. Continued use after an update becomes effective means you accept the revised terms where permitted by law.
